It seems like every part of water rights was created by people going “oh shit, I didn’t think of that. Okay, here’s what we’ll do for now but we should come up with something more solid in the future.” And then just stacking generations of those fixes on top of each other.
The eastern US cares less if someone downstream calls dibs on the water, which means that it can lead to its own kind of hijinks with people buying land upstream and screwing with people downstream. But the dibs thing is crazy too.
To be clear, I’m not claiming that the system of the eastern US would actually be any better in any major way. I don’t know one way or another and even coming up with an opinion on that seems like a lot of work for not a lot of reward. All I know is that it’s weird out here.
