Finally, while Kash might be surrounded by a lot of people who wouldn't take a call from the Atlantic or answer their questions, I doubt there are a lot of people in the Las Vegas bureau sufficiently loyal to him to lie and open themselves up to perjury.

Also thinking that the people who would know this could be deposed without the Atlantic needing to identify their sources. (They could probably just depose whoever would be the person who makes the call on breaching equipment or the team who would do it.)

I'd imagine there are a ton of career people who both witnessed the drunkenness AND want him gone enough to have talked to the Atlantic. Also thinking there are probably a number of people who could verify objective facts directly (e.g. were they asked to provide breaching equipment and by whom?)

Guessing someone at DOJ will draw the short straw and have to write a strongly worded letter alleging defamation per se providing no specific examples that isn't worth the paper it's written on.

Also guessing they would depose whoever was asked to supply the breaching equipment and team. Sounds like it never got to the point of them actually knocking the door down, but I'd imagine they could probably narrow who would take that request down to a small number of people.

Someone who actually knew what they are doing who would get a lot of cases going at the same time, put in a full work week sober and not destroy the cases by doing a supervillain monologue about investigating people out of spite could be doing a ton of structural harm.

Yeah, I'm kind of glad that we have an incompetent drunken clout-chaser in that role compared to the kind of damage that could be inflicted by a competent director who knew not to say damaging things with other capable zealots reporting up to them.

Would also be nice to see a bunch of them come from schools other than Harvard, Yale and Stanford to get some diversity of backgrounds in there as well.

All that and staggered terms that are still fairly long, but not, say something where there's an incentive to install a thirty-something who could be there for 50 years. Also, instead of a justice for each circuit, assign the initial disposition of appeals to a randomly assigned panel of three.
