Also worth noting: this is Patel's second defamation lawsuit over allegations about his drinking. He previously sued an MSNBC analyst over similar claims.
It means knowingly publishing something false, or publishing it with reckless disregard for the truth.
One First Amendment lawyer put it bluntly: the complaint "doesn't even hit the backboard."
Here's what you need to know about defamation law: Patel is a public figure.
That means under New York Times v. Sullivan—the landmark 1964 Supreme Court case—he has to prove The Atlantic acted with actual malice. That's a very high bar.
The Atlantic interviewed more than two dozen people for the piece. Fitzpatrick has said she stands by every word. The Atlantic is calling the lawsuit meritless.

This is horrifying. I wish it were surprising. But it seems to be in keeping with so many of the things happening right now.
The fact that a rape academy is allowed to be hosted online is, to put it very mildly, a travesty to humanity.
