It’s interesting to publicly give up on the fiction of persuadability, which is obviously part of the justices’ role morality, but which also, I think, protects them in ways they may not fully realize.

Of course, they might have exaggerated their uncertainty in an attempt to persuade their colleagues not to rush to judgment. But a majority of the Court seems by this point to have abandoned even the pretense that lower court decisions, fact development, full briefing, etc. are worthwhile.

I see what you mean! I suppose the overall story is one of neglect, but SCOTUS is sometimes willing to intervene—just on the side of the state. (Which feels of a piece with its recent insistence that the government suffers irreparable harm when it can’t immediately carry out the president’s will)
