Elementary is one of my favorite shows of the century so far: smart, funny, and touching, anchored by two excellent performances. People underrated it because it was a network procedural instead of a prestige-cable serial, but I’m glad to see it getting its due on Bluesky

Exactly—such a strange thing to brag about! I guess it’s meant to suggest that they’re uniquely insightful, but it feels to me like they’re confessing their own superfluity

It’s interesting to publicly give up on the fiction of persuadability, which is obviously part of the justices’ role morality, but which also, I think, protects them in ways they may not fully realize.

Of course, they might have exaggerated their uncertainty in an attempt to persuade their colleagues not to rush to judgment. But a majority of the Court seems by this point to have abandoned even the pretense that lower court decisions, fact development, full briefing, etc. are worthwhile.

Those SCOTUS memos are interesting to me in part as evidence of the justices’ metacognition. Justices Kagan and Sotomayor clearly contemplate that their minds might change with more facts and new arguments, but they seem to be the only ones.

This is an important account of a big-picture change in the Court’s methods that impacts many areas of substantive law. Exactly the kind of meta-doctrinal work that legal scholars should be doing right now, imo!

Just to highlight one of the many problems with this opinion, the one closest to my wheelhouse: reading the language of a TRO as though it were a statute is a huge conceptual mistake.

I see what you mean! I suppose the overall story is one of neglect, but SCOTUS is sometimes willing to intervene—just on the side of the state. (Which feels of a piece with its recent insistence that the government suffers irreparable harm when it can’t immediately carry out the president’s will)

Among other things, it made clear to me how the federal execution spree at the end of Trump 1 was a harbinger of Trump 2: haste and procedural sloppiness, enabled by SCOTUS, all in the service of gratuitous death
