I’m all for criticizing the Congresswoman when she’s wrong, but she ain’t wrong here. This is a terrible take on many levels.

You have this issue completely backwards. The absence of force ≠ consent. The absence of “no” ≠ consent. Getting drunk ≠ consent. Going to someone’s room ≠ consent. Consent = voluntary agreement of a competent person. Someone too drunk to remember what happened was not competent. Go watch the video.

Victim-blaming (“What was she wearing?”) and rape culture (“When you’re a celebrity they let you do it.”) were the accepted norm in this country in your generation. Neither are currently acceptable to anyone other than MAGA.

I’m accepting your premise that the victim was “too intoxicated” during the sex to assess attendant details. You, however, seem incapable of understanding that someone “too intoxicated” during sex to assess the attendant details does not have the ability to consent. It’s definitional.

Swalwell doesn’t deny the sex. The question is consent. If one party to the sex “was ‘TOO INTOXICATED’” to recollect details of the event, then by definition, the sex could not be consensual. Therefore, it doesn’t matter what the details of the events were, and credibility is not an issue.

If “she was in no state of mind to determine either,” then there could not have been “consent.” That’s not hard a concept to understand.

Maybe, because front-running to be Governor of CA is a bigger deal than running for Congress or a Presidential campaign no one took seriously? Maybe, because she had to work up courage to come forward, knowing that people would question her motive and timing? Maybe, the timing doesn’t matter.
