A lot of very brave people in Baton Rouge came forward (over and over and over again) to make sure Troy Lawrence Jr. couldn’t wear a badge anymore. He would still be in uniform if BRPD leadership (and the Parish Attorney) had their way.

This seems really sloppy. There are plenty of cases (including very recent 2d Cir. precedent that you don't discuss) exploring the interplay of the First Amendment rights of bar members and a state bar's rules of professional conduct. See, e.g., Cerame v. Slack, 123 F.4th 72 (2d Cir. 2024).

Sure, but then the same point holds. Assuming ideological alignment trumps "quality" (e.g., competent writing), presumably they could wait until 3L to hire and do an even better job figuring out who are the true believers (and who are just in it for the free chicken sandwiches and clerkships).

This usually gets portrayed as a sign of conservative legal movement discipline, but is it? Not that clerkships are some perfect meritocracy, but this seems like a recipe to get less qualified clerks. Wouldn't a disciplined movement would solve the collective action problem and hire later?
