Because he hasn’t been charged with Insurrection (sec 2383). So if we interpret the 14th so narrowly, then it’s basically useless. Courts have to be able to decide an appropriate burden of proof, standard of conducting the evidentiary hearing, etc.

SCOTUS is going to have a hell of a time figuring out how to put tfg back on the ballot without declaring “The feds, meaning us and only us, decides who get on ballots.” Every single dispute about a nomination paper is gonna clog the federal courts.
