Trybunał zasądził na rzecz skarżącego 7,650€ tytułem słusznego zadośćuczynienia za naruszenie prawa do sprawiedliwego procesu. Uzasadnienie wyroku: hudoc.echr.coe.int/?i=001-237968
Sąd Apelacyjny także zignorował fakt odbycia przez skarżącego ponad połowy pierwotnie orzeczonej kary. W ocenie ETPCz, uzasadnienia wyroków SN i SA nie spełniły standardów nakazujących zapewnienia proporcjonalności między interesami skarżącego a interesem wymiaru sprawiedliwości.
Zdaniem ETPCz, @SN_RP_ nie wyjaśnił, na czym polegały rzekome fundamentalne defekty postępowania wymagające korekty. Co więcej, SN w żaden sposób nie odniósł się do wpływu swojej decyzji na sytuację skarżącego, który już wtedy przebywał na warunkowym przedterminowym zwolnieniu.
Polecam uwadze dzisiejsze orzeczenie ETPCz w sprawie Zakrzewski v. Poland (naruszenie) Art. 6 Konwencji - wniesienie kasacji przez Prokuratora Generalnego po ponad 5 miesiącach od wydania prawomocnego wyroku Trybunał uznał za wznowienie postępowania, a nie zwyczajny środek zaskarżenia. 🧵
