Does it kinda suck? Yeah. It does. It forces them to essentially bully fangames. But its the system kinda FORCING THEM to. Nintendo being aggressive about that is symptom of the problem, not the problem itself.

If you dont vehemently protect your copyright, you more or less loose it and its almost like it goes public domain.
Because if you cherry pick which types you enforce it others can point and go "Well how come you didnt there?" and the likelyhood of loosing the case against the infringement increases

Its not about quality or reputation. If, say, people kept making Mario games and Nintendo didnt strike them down ever. Then someone decided to make a Mario game, and monetize it. The Copyright would be harder to enforce because they never protected it in the past.

Nintendo isnt the only company that does this.
But the Patent thing was blatantly malicious and Im glad they are loosing there.

Basically with copyright: If you dont aggressively protect it then you set the precedent that anyone can use it, and thus lose the ability to protect it later. While this sucks for fangames, it also means other more malicious parties cant monetize and profit off of your IP.

You mean the Patents. Copyright is a whole different ballgame. And them being aggressive towards protecting COPYRIGHT, sadly is necessary as if you do not protect an IP you an actually lose the control of it.
The PATENT thing is another story, though. And they are losing that battle, thankfully.
