Agriculture shifts from climate-change culprit to victim in new lawsuit A lawsuit in Switzerland could prompt farmers around the world to sue their governments for climate inaction.

The farmers’ lawsuit in Switzerland “is interesting because it is turning the tables on this framing by arguing that farmers can also be the victims of climate change,” says Emily Bradeen, a policy analyst at @granthamlse.bsky.social. @cohelongo.bsky.social

The ECtHR's 2024 climate cases were decidedly dogmatic concerning extraterritorial jurisdiction. Lea Raible analyzes this - and its interplay with positive obligations - in the first article of our upcoming special issue on the climate rulings, co-edited by Armando Rocha & @cohelongo.bsky.social.

Vindicating the ECtHR’s Role in Environmental Matters: Cannavacciuolo and Others v. Italy - Strasbourg Observers Corina Heri On 20 January 2025, the ECtHR issued a Chamber judgment in Cannavacciuolo and Others v. Italy. This environmental pollution case concerns an area known colloquially as the Terra dei Fuochi (“Land of Fires”) because it is notoriously plagued by the illegal dumping, burying and burning of waste on private land. This decades-long practice, […]

This is good - there were worries that Switzerland, which has pushed back strongly (and very problematically) against the judgment, would manage to get this process closed again as soon as it started. Instead, looks like the Council of Europe and the other States want to see more from Switzerland.

and its reliance on a quantification, through a carbon budget or otherwise, of national greenhouse gas emissions limitations. It also requests more information on adaptation measures and procedural safeguards by the next supervisory meeting (September).

The decision, voted on by representatives of the Council of Europe Member State governments, notes recent legislative changes, but still want to see more details of domestic measures, namely on: the draft CO2 ordinance; the domestic methodology behind the legislative and administrative framework;

In it, the Ministers’ Deputies rejected Switzerland’s arguments that they’ve completed the implementation of the judgment already, and that no further monitoring is needed (whew!).

I signed this letter, reflecting on the difference it makes to have a secure contract and channeling @marinavelickovic.bsky.social in Critical Legal Thinking about what we do when “the discipline you are hoping will accept you will only do so in exchange for your silence at the dinner table”.

This is so outrageous I actually had to double check it was real. What an unintentionally clear window into why all kinds of people dislike and distrust mainstream media institutions.
