I would be shocked if the @wipo.int Broadcast Treaty is recommended for a diplomatic conference by #sccr46 The text appears to be a long way off from the consensus described by the chair in SCCR 45. It is not carefully limited to signal piracy and has many provisions on post-fixation activities.

The United States Government has no legal authority to snatch a person who is lawfully present in the United States off the street and remove him from the country without due process. The Government's contention otherwise, and its argument that the federal courts are powerless to intervene, are unconscionable.

Interesting question. It could certainly be in the mix, but I have not heard it being considered so far. Maybe it is an interesting time for a blog or short article. Ip cross retaliation can have the benefit of decreasing, instead of increasing, costs in the retaliating country.
