They may think they are selling me a license, but I'm paying the product itself and I do what's necessary to preserve that ownership regardless of what they think they are selling me. If no work-arounds are available, I don't buy.
This is new territory though. Now they are trying it with hardware.

In my perfect world, the lack of sales would be people seeing that according to Nintendo, they don't own the hardware anymore, but instead are purchasing a "license" to use it and don't want any part of that. It's likely just the price, but that's good enough. Nintendo no longer deserves our money.
