Ces groupes politiques ne souhaitent pas s’arrêter là. Avec la proposition de loi du député Charles Rodwell visant à « renforcer la sécurité, la rétention administrative et la prévention des risques d’attentat », la droite, l’extrême droite et la Macronie souhaitent également interdire aux personnes étrangères qui cherchent l’asile en France de changer de prénoms si c’est interdit dans leur pays d’origine. La proposition de loi, déjà adoptée en commission des lois, imposerait également de fournir un extrait de casier judiciaire pour tous les changements de prénoms, de personnes étrangères ou françaises.

Le changement d’état civil au tribunal est une procédure qui renforce les discriminations. Elle est longue et inutile : 99% des demandes finissent par être acceptées selon le Ministère de la Justice. Et elle coûte cher à l’État : au moins 20 millions d’euros en 10 ans. Il est inacceptable que les personnes trans, population ultra précaire, financent leurs propres discriminations.

Avec la PPL du député Rodwell, la droite et la Macronie souhaitent interdire aux personnes étrangères de changer de prénoms si c’est interdit dans leur pays d’origine.

Déjà adoptée en commission, elle imposerait aussi de fournir un casier judiciaire pour tous les changements de prénoms.

Au milieu de ces lignes de lutte s’est glissée une mesure rétablissant l’article 1635 bis Q du code général des impôts qui introduit, à compter du 1er mars 2026, une contribution de 50€ pour saisir un tribunal judiciaire ou un conseil des prud’hommes. Le message est simple : pour faire valoir ses droits, il faut désormais passer à la caisse.  Cette nouvelle mesure intervient alors que l’ensemble des associations trans et LGBTI, rejointes par la Défenseure des droits, dénoncent l’actuelle procédure de changement de sexe à l’état civil qui se fait au tribunal.

Une procédure semée d’embuches qui permet aux magistrats d’imposer des exigences arbitraires, transphobes et misogynes contre les requérant·es, et qui plonge les personnes trans dans des allers-retours administratifs de plusieurs années durant lesquelles elles continuent à subir des discriminations. Mais au lieu de répondre aux revendications unanimes pour l’instauration d’un changement d’état civil libre et gratuit, le gouvernement et ses soutiens ont choisi de rendre la procédure judiciaire actuelle payante.

Dans le budget 2026 s’est glissée une mesure qui introduit, à compter du 1er mars 2026, une contribution de 50€ pour saisir un tribunal judiciaire ou le conseil des prud’hommes.

Le message est simple : pour faire valoir ses droits, il faut désormais passer à la caisse.
