The advantage of this, from Millett and Garcia's perspective, is that it means that the Supreme Court can't issue its own stay before DC Cir has a chance to weigh in. If they had simply denied the stay, the SG would have run to the Supreme Court and possibly gotten an immediate, much longer stay

They have done so without publicly addressing the stay factors.
