Ugh, that’s sad. It’s been a rough few weeks for ALX bookstores.

They generally adhere to that rule but sometimes break it (I believe) when a portion of the court is sitting in a non-DC location.

The Fed. Cir. IOPs define “Merits Panel” as “three or more judges.”

That said I am not aware of the court constituting a panel of more than three judges in recent memory.
