7/ After five years and counting of increasing state repression, this is a further act of democratic dispossession, not just of the rights of activists, but of the rights of juries and jurors, and as such, of all of us.

6/ As they currently stand of course, the government’s proposals on jury reforms are likely to resolve the jury equity problem, at least in protest trials, by effectively placing jury trials outside of the reach of activists.
5/ If jury equity is centre stage, notably in the Defend our Juries campaign, it is because juries are no longer able to decide, in the cases of activists, on these justificatory defences; equity is all that is left.
4/ But it is in many ways a red herring. The real issue is that over the last five years the government and Court of Appeal have stripped away the necessity and lawful excuse defences that previously enabled defendants to make legal arguments in court.
3/ Jury equity is a fundamental democratic principle of the legal system, but the current situation is that that principle cannot be named or recognised in court.
2/ Three principles protect the independence of jury decision-making:
1. That no judge can direct a jury to convict;
2. That juries do not have to give reasons for their verdicts;
3/ That jurors cannot be sanctioned for their decisions.
These principles date back to the Penn and Mead case of 1670.

1/ What is jury equity?
Jury equity is the principle that juries have the power to acquit a defendant even where they think that the defendant has broken the law, and the defendant has no legal defence to the charge.
