JUST SECURITY At the same time, the PRA respects the President's status as the head of the Executive Branch in a number of ways. First, the Act allows Presidents to exercise essentially unreviewable discretion to designate diaries, personal notes, and other documents created in the President's personal capacity as personal records not subject to the PRA's preservation and disclosure requirements.
(b) Documentary materials produced or received by the President, the President's staff, or units or individuals in the Executive Office of the President the function of which is to advise or assist the President, shall, to the extent practicable, be categorized as Presidential records or personal records upon their creation or receipt and be filed separately.
This perpetuates a far too common misunderstanding of the Presidential Records Act.
PRA explicitly defines presidential records and personal records, and requires POTUS to categorize records created or received according to those definitions, with no discretion to "designate" or "deem" or "decide."
So, it's okay for a cat to run away and hide under the bed when visitors come, but,
when I do it, it's "rude" and "antisocial."
