Base violent crime rate for all residents in MN is 2.6 per 1000. In a group of 4000 people, 10-11 would be wanted for a violent crime. So only 20 additional accused offenders. At the cost of at least two innocent lives, dozens of injuries, teargassed children & trauma. But the cruelty is the point.

The district judge got slapped by 8th Circuit the first time on the commandeering argument—although not a merits ruling—but honestly it is not a perfect fit, because it is underinclusive of the harm: directly undermining state police power re state citizens, core to 10th Amendment dual sovereignty.

Just look at the second demand— on sanctuary policies. In Trump I , DOJ lost on that argument in every Circuit but one, and that was when all they were doing was withholding Byrne grants as the sanction. And the voting record demand is pure thuggery, it is core state control under Elections Clause.

Spoke to some fresh-faced Ohio Guardsman at the Wharf this weekend. They love DC! Then came home, looked it up: Cleveland, Ohio has a higher per capita murder rate than DC. What is Gov. DeWine even doing? (PS-I told them next time to come back with their families, as tourists)

The simulacrum point is fascinating. I drove from the Tidal Basin to Union Station along Constitution Avenue earlier this week, a drive I have done hundreds of times. Other than the same security always present around the White House, I saw just five guys in military gear (maybe these same guys!)

More worrying was what I did not see: people on the Mall & in the street. There is a chill on DC’s urban core reminiscent of what we saw during the pandemic. Restaurant reservations are down and so is foot traffic. Hopefully things will pick up after Labor Day, but scenes like this sure won’t help.

i find this image so fascinating. it is both a literal example of authoritarianism but also a second-hand reproduction of the aesthetics of other authoritarian states. it's like a simulacra of authoritarianism whose purpose is to attempt to make the simulacra real.

Same. I try to keep it to 50 pages, per my teaching mentor. I also ask for a presentation by each person once in the semester on an assigned law review article (this year some great stuff, includes Bulman-Pozen, Saiger,Seifter, Shoked)

$25.2 million dollar cut just made by Trump to DC budget, on top of massive cut made by Congress in FY 2025. Unfilled judicial posts for years, making it harder to process people charged with crimes, because Congress needs to approve DC judges. President should fix that before sending in fed agents.

Preemption would be fine if Congress would do a comprehensive AI bill, but now? Please. It would mean NOBODY will regulate AI. This would repeat the mistake made with the preemption of state regulations in Section 230 on platform liability on web.
