this is very misleading fwiw, there's an exemption for if the device meets currently-voluntary efficiency targets that basically everything does anyway
my personal take is that if they convinced people at kde ev who i know both have significantly more information about the situation than is public and also were very reticent to trust them then i'm okay going along with that

i wouldn't consider that guaranteed, i don't think it's really clear yet whether the xbox one exploit found recently can viably be done by a modchip but it took a good like 15 years either way and the switch 2 is generally agreed to be comparably secure to the xbox one
there is a hardware exploit already technically it just has such a low success rate that it would probably kill the motherboard before it succeeds (expected timescale before a success is ~months, so not *impossible* to achieve)
fwiw i think there being a switch 2 hardware exploit eventually is a foregone conclusion. a useful software exploit is unlikely though and it's up in the air if any hardware exploit will be reliable enough for a modchip or just doable under laboratory conditions
connecting to the internet on a system with a pirated game installed is an instant ban though
afaik nobody has ever been banned for anything other than piracy or obviously bad ideas (ex. importing a custom profile icon). nintendo doesn't care about homebrew and isn't interested in banning for mods that don't affect other players

it'll be read only but hopefully the pkhex home plugin will be able to read pokemon deposited from wind/waves. if not someone will probably reverse engineer the mobile app
