Being a pragmatic approach, I can see why judges find it very attractive. But that doesn't mean they need to be wedded to it. Australian judges, for example, are not blind to its attractiveness - but they don't forgo careful analysis in their judgments (some of them at least)!

Whilst I wasn't expecting forensic analysis, some of the analysis is sloppy. In an article about 'equitable ownership' you would expect some engagement with (or even mention of!) discretionary trusts and charitable trusts..

Quite apart from Chitty, Morris's contributions were notable: Conflict of Laws, Theobald on Wills, the Rule Against Perpetuities (and probably others too). A very impressive breadth (and depth) of knowledge!
