But what it comes down to is this: do you think the duty of confidentiality exists to protect the *appearance* of proper behavior by judges?
Or is it supposed to protect the *likelihood* of proper behavior?
Anyone who doesn’t grapple with the misconduct issue as it relates to this and just uses high-minded rhetoric to appeal to a generic duty of confidentiality has not thought much, if at all, about the duty of confidentiality as related to the judiciary.
Or feel that they know better than the Constitution? Or feel they are superior to everyone?
But what if your boss, in deciding an opinion, says something horrifically racist about one of the parties?
That is also clear misconduct, and I think should be discloseable.

On the easiest level, you should be able to tell people if your boss sexually harasses you. That much I hope we agree with.

When I spoke to Judge Scirica to try to get some understanding about what duties I actually owed my judge, I was told that I did not owe any duties in the case of misconduct but I couldn’t tell anyone anything to figure out if misconduct had occurred without potentially violating that duty.
The duty of confidentiality imposed on you as a law clerk is actually incredibly opaque.
I have a vested interest in this topic since my fucking boss used those duties to tell me I couldn’t talk to even a therapist about what he did to me.
