Courts generally defer to the president on whether the statutory triggers are met. The role of the judiciary mainly comes afterward, reviewing whether the military and federal officials operate within constitutional limits once deployed, not whether the invocation itself was justified.

Historically, courts have treated the president’s determination that conditions exist for invoking the Act as non-reviewable, going back to Martin v. Mott (1827).
It remains in effect until the president decides otherwise, unless Congress steps in and passes new legislation — something that is practically impossible because Trump has completely captured the Republicans in Congress making it so we do not have a Congress.
There is also no built-in mechanism to automatically end an Insurrection Act deployment.
The statute does not clearly define key terms like insurrection, domestic violence, or what it means for a situation to “make it impracticable to enforce federal law.” Because those terms are vague, presidents have broad room to interpret when the Act can be used.
Here’s the problem: the Insurrection Act has very few guardrails. The decision to invoke it is entirely at the president’s discretion.
I’m seeing MAGA talking heads and administration officials on TV and social media starting to use the word “insurrection.” They are laying the groundwork for the invocation of the Insurrection Act.
A new top Justice Department appointee brings a bizarre past to the job: he was a state judge in Oregon but was, in 2018, suspended by a state ethics board over misconduct allegations.

Everybody’s wondering why Trump would appoint deeply unqualified and incompetent people to senior intelligence positions. Is it possible they are Trojan horses?

Does the 11th Circuit still kick the Florida case back to Cannon or do they let her ruling stand? I hope they kick it back even if it will be squashed.
