In the twentieth century, this trial-centred perspective was subordinated to that of the new criminal appellate courts. The article traces how, in a series of landmark decisions, the House of Lords developed the modern law of homicide on nineteenth-century foundations.
It focuses on nineteenth-century trials where, as full adversarial process took hold and societal fears about interpersonal violence grew, judges refined malice aforethought to focus on intention and narrowed the excuses of provocation and intoxication.
Our Senior Lecturer Phil Handler published the open-access article 'Malice Aforethought in England, 1785–1967'. The article charts the evolution of malice aforethought—murder’s defining element—from the late eighteenth century to the late twentieth century: www.tandfonline.com/doi/full/10....
So very proud of our Professor, Lucy Frith!
