I haven't been following the birthright citizenship case, but after spending the last year writing about fetal personhood, it strikes me that the right is trying to read birth out of the 14A in both directions. Immigrants born here shouldn't get rights but fetuses not yet born should.

We conclude that abortion bans are failing at both their *purported* aims of saving fetal life and protecting maternal health. Since Dobbs, more fetuses are dying every month through abortion and maternal health is plummeting. Given this, one might call bans irrational, unworkable, or arbitrary.
OTOH, patients stuck in ban-state hospitals are often at the mercy of others. Their self-help recourse is limited by their medical emergency & the hospital's surveillance. This post-Dobbs reality is the opposite of pre-Roe, where hospital abortions were safe but outside them were often dangerous.
We dig into the data showing that if you account for abortion travel, shipped medication abortion, and in-state care, abortion rates have seemed to increase in every state with an abortion ban but two. The average abortion patient is finding ways to navigate around bans and access care.

I finally had a chance to sit down with this article. As others have noted, it is really, really good. It is hard to see how anyone can make a scholarly originalist case for fetal personhood after this. Def recommend reading it - some of my favorite parts are... 1/
