After hearing the oral argument, I stand by the below. Roberts writes the majority opinion. Alito/Thomas concur in judgment only, saying the EO extended past statute. Gorsuch concurs separately about Native Americans. The 3 liberals separately say originalism should be better cabined.

My prediction: 9-0 declaring the EO unconstitutional, with Alito and Thomas writing separately to say the majority doesn’t get the originalism right, and a separate concurrence by Sotomayor, Kagan, and Jackson saying (correctly) that this was a cynical, racist, and downright un-American attempt.

I worry that Alito and Thomas have never met a revanchist argument they didn’t like. I just hope that Roberts, Gorsuch, Kavanaugh, and Barrett show fidelity to the plain text, and, while unnecessary to address original intent, point out that it’s original public intent and meaning were also plain:

The 14th Amendment says what it says, and no amount of Trumpian attempts to ignore that plain language will work. Any Supreme Court since the 1860s would have knocked this one away easily.

Yes, some people at the time thought the children of immigrants weren’t citizens. Also some people at the time (mostly the same people!) thought black people should be slaves. These people were horrific, and we should aggressively ignore their opinions about who “gets to be” an American.

If “legislative intent” has been compared to “looking over a crowd and picking out your friends,” the revanchists’ method of “originalism” is looking at a much larger crowd, where half of the crowd was slaveowners and other incorrigible racists, and picking out the most racist quotes.
