My hot take is that the inter-American free speech system and jurisprudence has the foundation to be more protective of speech than the 1A . Yet, there’s a lack of regulation around low-value speech or compelled speech that is hard to operationalize at national level.
There’s a lot of doctrinal mess in first amendment law. But once you see how it’s core principles influenced the protection of speech worldwide, you can’t unsee it.
