Instead of immigration custody, #Flotilla activists are held in a remote high-security prison, I told @reuters.com. Israel’s security minister called them terrorists who should “smell the terrorists’ ward” for months. Under Israeli law, however, there’s no basis for either deportation or detention.
As we watch the interception of the #flotilla unfold live, I outlined the legal framework governing this unprecedented state action: the raiding of 50 boats flying different state flags and the abduction of around 500 people coming from about 50 countries in international waters.

One of the eight suspects in the #ICC case on #incitement to #genocide is Zvi Yehezkeli, an influential Israeli “journalist”—one might call him part of Israel’s own “Radio Rwanda.”
Israel has previously acknowledged the *intentional* killing of (Al-Jazeera) journalists. The targeting of local journalists aligns with Israel’s ban on foreign reporters, and recently, even on foreign doctors—who, once home, testify to what they witnessed.
Also the *second* strike may not have been a “regrettable mistake,” as PM Netanyahu claimed. Evidence suggests and there is room to argue that the strike that killed the journalists was a deliberate, independent attack. That the journalists were not collateral damage but the target.
In any event, already this first strike was a grave breach of international humanitarian law, violating the principles of distinction, precaution, proportionality, and the special protection afforded to medical units.
Only days earlier, a Palestinian journalist had documented the starving children’s ward for Israeli outlet #Haaretz. Coincidentally, he is one of the five who were killed.
Double tap presumes the *first* strike is on a legitimate military objective. What makes it unlawful is the subsequent strike. Here the alleged target was a camera located in a hospital. The IDF knew journalists were operating there.
Was the attack on Nasser Hospital in #Gaza, which killed 22 people inc. 5 journalists, a “double tap”?
