Basically, the early default configuration of a human fetus is female. If we were to assign people's sex at CONCEPTION, everybody would be female.

The executive order defines sex "at conception," but biologically, embryos don’t develop male or female characteristics until weeks after. Unless a Y chromosome interferes six to seven weeks later in development, the standard process for a fetus is to develop female characteristics.
