Courts (especially in California with its specificity pleading requirement) know that employers constantly try to threaten employees who go to work for competitors and tend to regard these sorts of claims as meritless bullying until clearly shown otherwise.

That is true, but the letter fails to identify a single specific piece of trade secret information that they have disclosed or used. That is why this reads as a “the client told me to write a thread letter” one and not a “we have a serious claim we could plausibly litigate” one.

No - that’s just general skill and knowledge. It doesn’t meet the definition of a protected trade secret. You don’t get to own your ex employees and prevent them working for a competitor just because your employees know how to do their jobs.

CA also requires pleading with specificity in trade secrets lawsuits. You have to identify the particular protected information with particularity at the outset.

FWIW, I’d still view judicial reform as a high priority - particularly adding lower court judgeships to keep up with caseload growth (and dilute ideologues) and reforming SCOTUS so it sits in panels with a majority of the panel being judges temporarily designated from Circuit courts

I agree that ~95% of the worst stuff from this court (anything related to administrative law or statutory interpretation) is solvable through a majority in Congress and abolishing the filibuster.
