How Trump’s SAVE America Act could make it harder for married women to vote Millions of women could face new challenges to voting under President Donald Trump’s SAVE America Act, which would require voters to prove their citizenship before casting a ballot. The federal legislation would mandate that most Americans show a birth certificate or passport to register to vote. But people with names that don’t match their birth certificate in some instances could have to produce additional documents like a marriage certificate or divorce decree linking their past and current identities.

I offer some thoughts here on possible constitutional challenges to the SAVE Act. www.newsfromthestates.com/article/how-...

Virginia Minor

Virginia Minor

On this day in 1875, the Supreme Court rejected Virginia Minor’s argument that the right to vote is an inherent privilege of federal citizenship. Minor v. Happersett’s insistence that the Constitution “does not confer the right of suffrage upon any one” remains in force. #WeTheMen

On the OH SCt Allen’s first opinion upheld the constitutionality of the broader category of proportional voting in Cleveland under the state right of municipal home rule. This democratic system saw the election of the first women to the Clev City Council, Marie Wing & Helen Green. #FirstWomanJudge

A version of ranked choice voting, a Progressive reform, is how the first woman judge elected to any state Supreme Court in the nation, Florence Allen, was elected as an independent candidate to the Ohio Supreme Court in 1922 (and the Cuyahoga Cty Common Pleas in 1920).

Divorcing Summit Co. couple nears resolution in battle over embryos Frozen embryos have drawn out a Summit County divorce for years. A novel court ruling could give each side what it is seeking.

I help interpret here an Ohio case trying to find a compromise in a post-divorce frozen embryo case awarding wife all the embryos but seemingly giving husband ways to opt out of parenthood.

Eldridge, Ireland and Derry's "Celebrating Women in Legal History" Lorren Eldridge, Emily Ireland, and Caroline Derry have published Celebrating Women in Legal History: Making and Shaping a Discipline (Hart/Bloomsbury):This book champions the work of women in legal history, and their contributions to both the discipline and feminist activism over nearly two centuries. It considers women in academia, which was, in theory, open to women before they could become lawyers in most European countries. And it considers women working beyond the academy: many studied legal history in other ways; in local history societies, through archival work, and via activism. Women legal historians have been under-recognised or forgotten altogether, even where they made substantial scholarly contributions. In focusing on the work of women in legal history, this book lays the foundations for a transformational reassessment of the discipline. It asks searching questions about what counts as legal history. It demonstrates that work by and about women should appear in our legal history courses, be discussed in our seminars, and be cited in our academic work. If the field of legal history is lively, innovative, and wide-ranging, everyone working in it benefits. By shining a light on undervalued scholarship, and areas which have received insufficient attention, we challenge assumptions in our discipline and advance its methods. Whilst some women were pioneers and worked to change gendered aspects of the law, others led more ordinary lives, disappearing from the gaze of legal history even as they contributed to it. This book tells some of their stories. --Dan Ernst.  TOC after the jump.  Foreword, Erika Rackley (University of Birmingham, UK) 1. I've created a Legal History starter pack as I don't think anyone else has and it seems like the type of thing we should have. I'm sure I missed people (apologies!), so hit me up if I have: go.bsky.app/XJxJpA
