Rule on #FISA reauth goes down in flames 197-228. GOP will now try to push a reauth extension to the end of April 2026 on Monday.

Correction, previous question vote.
Rule passes.
Johnson only needs one more yea and they'll gavel the vote closed & move on.
This is where we are on the Rule at the moment. They've held the vote open for nearly an hour at this point...and the rule is failing. The #FISA follies continue....
Well, the House is back in session with the House GOP leadership having introduced a revised #FISA Section 702 reauth bill that contains no warrant requirement to search stored 702 data. Text available here:

“People were tortured inside the Adelanto ICE prison. GEO Group is fighting to keep the records secret so the public is kept in the dark about what’s really going on there,” said [me w/ @thesouthlander.com] “The taxpayers who fund that facility deserve transparency.”
When a major and growing Second Amendment defense organization comes out against #FISA Section 702 reauth, it's turning into a VERY bad day for Trump & Johnson.

These are the stakes in the #FISA debate.

The House has been in recess for nearly 45 minutes now. Looking like #FISA clean reauth opponents are, at the moment, winning. Whether the negotiations will actually result in a warrant requirement provision being made in order is the big unknown.
The #FBI is, in secret, rewriting its own rules about who can be surveilled, under what circumstances, and for how long. Huge scoop by Ryan Lovelace at Racket News. (paywalled)

Happy Wednesday
The fact that the House has adjourned until 10am tomorrow (April 16) means Johnson's #FISA meltdown is well underway. The plot thickens. 😎
Always remember that the regime is constantly scanning social media feeds for opportunities to prosecute people for speech they find objectionable or notionally threatening.

10/end) Final piece for now, on how the Gaiser "PRA is unconstitutional" legal opinion out of DoJ could help expand #FISA Section 702 abuse.
9) And here's that #FISA Section 702 parallel construction piece.

Still more from me on #FISA Section 702, this time about how a DoJ Office of Legal Counsel (OLC) opinion could help fuel surveillance abuse of the program.
My colleague @davidjbier.bsky.social going head-to-head with Trump on the regime's attacks on legal immigration. Love it. 😎
Johnson is terrified of losing the vote on the rule governing debate over #FISA reauth without amendments. All I can say to the holdouts is, hang tough for the Bill of Rights because that's the oath you took.
This constitutes fighting authoritarianism, not simply complaining about it. Props to the gentlelady from Arizona.
America's would-be dictator/king seems rather worried that his FBI agents may be forced to get a warrant to search the #FISA Section 702 database. The House is currently in recess because the Rules Committee last night denied any amendments to the FISA reauth bill & key GOP members are in revolt.
Another potential #FISA Section 702 attack vector on constitutional rights. My latest, out now via @justsecurity.org

Rules Committee hearing has adjourned. Assuming Johnson's statement today that no #FISA amendments will be made in order stands, tomorrow's vote will include no reform amendments of any kind. We'll know for certain later tonight when the actual rule is voted on and posted to the Rules website.
Rules Dems are not doing themselves any favors by attacking the 18-month #FISA Section 702 reauth time period. When Title VII was passed in 2008, it was on a 4 year reauth schedule. In 2024, it was for 2 years. Now, 18-months is the proposal. That's a goal post moving in the right direction.
I'm kind of surprised that Raskin hasn't talked about the fact that we have a current (de facto) Second Circuit ruling saying clearly that a #FISA Section 702 database search requires a warrant. Also surprised he hasn't (at least thus far) mentioned the classified letter Wyden sent to the House.
When I hear people on the GOP side saying #FISA Section 702 is vital "to the war effort," it's important to remember that 1) the war is unconstitutional because it's never been authorized by Congress and 2) foreign military opponents (read Iran) do not pass battle plans over unsecured phone lines.
