2. luka dončić's application to register his name was refused based on likelihood of confusion w/ his mom's registrations for his name (w/ his consent)

yes, people can always use their names as names & to describe who created or makes something, but they can't use them as trademarks if they create a likelihood of confusion w/ similar marks in related industries--especially if doing so violates a prior agreement about them.
jo malone is the latest of those, & this article is chock full of quotes about her shock & dismay at being sued over the use of her name in partnership w/ zara: "i am a person...I can't stop being the person. ...I sold a company. I did not sell myself."

there are so many stories of designers entering agreements with corporations that involve the exclusive use of their name and/or ownership of their name marks, & then ending up in litigation after they part ways with the company & want to use their name commercially again
