What really grinds my gears however, is the fact that the court gave me one month to write my submission, but gave the prosecution 2 months for theirs. Incredible things happen in state court every day

I mean, obviously the other option would be that the charges are just flatly not supported by law, but I don’t usually feel that optimistically about the the average grand jury in reaching that conclusion

What is to be ultimately made of these stories? Are DC grand jurors just seeing straight through these charges as political fodder and purposefully refusing to indict or has the DOJ just degraded into jaw dropping incompetence?

Relatedly, I really just love the end-run around disclosure obligations with respect to conferral of benefits on a prosecution witness. If you promise a witness a new apartment before their testimony, Brady material. But if you relocate them immediately AFTER they testify, no problem really.

I always thought it was preeetty clear when the Brady court said “material either to guilt or PUNISHMENT” but alas. No state authority on Brady material reflecting upon sentencing.

Can’t really understate how helpful Twitter was for me when I was an undergraduate and law student. Opportunity to engage with future colleagues and seasoned veterans in the field about legal commentary was absolutely formative for me in my career. If I can recreate that here, it’s worth staying
