this reminds me, i don't think SCOTUS should be allowed to choose their own clerks. standardize the hiring schedule, put the applications in a pool, blind reads (perhaps by a panel of former clerks) and random assignments.

In regulating the SCOTUS appellate jurisdiction, it's not just that Congress can cut them out altogether (jurisdiction stripping), though they can. They can also impose procedural rules and limits. Radically restrain interlocutory appeals and "emergency" stays, for example.

In thinking about what to do about the rogue Court, we maybe focus a bit too much on court packing yes or no, granted that's the most important. But some of the less sexy things can be done by more mundane statutory fixes. Congress could, and should, nuke the shadow docket.
