Part 4: Non-Renewal Notices

When is a non-renewal notice required?

It varies depending on the type of rental agreement.

In a lease with a term, notice is NOT required. Unless there is an automatic renewal provision, the lease is assumed to end on the end date.

In a periodic month-to-month tenancy, written notice IS required. From landlord to tenant or vice versa, at least 28 days written notice must be given to the other party. Wis. Stat. 704.19 explains specific rules of how that notice must be given.

In a tenancy at will, written notice is required in the same manner as a periodic tenancy above.

Definitions to Know

Rental Agreement: An oral or written contract between landlord and tenant(s).

Lease: A type of rental agreement that has a definite start and end date, also known as a term. Rent is paid on a regular schedule.

Part 2: Automatic renewal

Do leases automatically renew?

In Wisconsin, typically NO: There is no right to an automatic renewal on a lease.

Unless the rental agreement contains a provision for an automatic renewal or the landlord and tenant agree to renewal, a lease ends on the last day of the agreed rental period. If renewed, the terms of the original rental agreement continue to apply to the renewed lease unless the landlord and tenant agree–verbally or in writing–about the terms that change.
