Here's the thing: Gorsuch asked exactly the right question because he and Sauer both know that, under the standard Sauer (Trump) is proposing, they would not be birthright citizens. Sauer couldn't just come out and say that, though, so he hedged, and Gorsuch let him because they have more to cover.
