BOTTOM LINE: It’s an output-based contract. If you believe the OUTPUT sounds/looks like you, you can contest it, just like a musician can contest someone sampling their music. Even GAI can be challenged as a replica if it sounds like you, because the contract is OUTPUT-BASED, regardless of prompt.

If they use a GAI system, they cannot prompt with your name without consent.

If they use some magical library of your audio, IN CHARACTER, from YouTube/film/TV (how many people have a catalogue this vast with clean audio stems?) that’s an ICDR and still requires licensing the source AND getting your consent AND negotiating a deal with you. Also, this is NOT a GAI prompt.

🚨 TO GET AHEAD OF THE “ICDR LOOPHOLES” ARGUMENT: 🚨

First off, you don’t have to consent to an ICDR. Full stop. If they use your game audio, past or present, that is automatically a DR. (Not an ICDR, not a prompt GAI.)

I have read the LBF. I have consulted with attorneys and leading experts in AI. This deal is LITTERED with consent. If you/your reps exercise due diligence, you will be protected.
