In a rare event, two University of Victoria historians were cited in a recent Supreme Court of Canada decision, Taylor vs. Newfoundland and Labrador. The case involves the Supreme Court's interpretation of the meaning of the Mobility Rights set out in s. 6 of the Canadian Charter of Rights and Freedoms. In canvassing the long history of the protection of freedom of mobility and movement in the law, the Court recognizes the way in which Canada has sometimes fallen short in its protections of the fundamental liberty of free movement. Citing the writing of professor emeritus Patricia Roy and the recent book, Challenging Exile, by professor Jordan Stanger-Ross with Dr. Eric M. Adams, the majority reasons note the internment and exile of Japanese Canadians as an example of Canada's previous violation of mobility rights.
