 Indeed, other than paving the way for the Plaintiff States’ immediate suffering, it appears that the primary effect of today’s emergency stay is to hand the Government an early “win”—a notch in its belt at the start of a legal battle in which the long-term prospects for its eventual success seem doubtful. And I don’t blame the Government for trying. If you’re likely to lose on the merits, why not use the Court’s procedures to fight on new and creative fronts? The Government has now gotten this Court to nullify clearly warranted interim injunctive relief, deflecting attention away from the Government’s own highly questionable behavior, all without any showing of urgency or need. I worry that permitting the emergency docket to be hijacked in this way, by parties with tangential legal questions unrelated to imminent harm, damages our institutional credibility.

No, the meeting did not go badly for Ukraine. It exposed in the most undeniable, unequivocal way possible the pro-Putin commitments of the president and vice president. That was information Americans and allies needed to have clear before them.
