Anthropic attorneys state that DOJ is justifying use of supply chain risk designation any time a contractor doesn’t give into contract demands by the DOD. (Live-blogging Anthropic v DOW)

Judge may be backing DOJ lawyer into a corner. Why is supply chain risk designation needed? Lawyer says that the restriction only needs to go so far, but when the judge suggests that DOW use his exact words instead of the “official designation” he backs off. It seems that designation means more

DOJ on DOW’s behalf seems more than willing to step back from most of Pete Hegseth’s assertions about Anthropic, recognizing that the secretary had no power to order other agencies or contractors to stop using Anthropic (outside of actual defense work by DOD contractors). The judge seems suspicious

DOJ: “I’m not aware of any authorities that would allow DOW to categorically bar work for non DOW” Judge Lin: “So why did secretary hegseth say this?” DOJ: “I don’t know”
