Birthright Citizenship will be on the docket at 10 AM Eastern tomorrow morning and I'll be live with the robes on YT, Substack, and TT. It's an important case, and worth hearing for yourself.
Primary source material in which the 1866 congress discusses the meaning of who Birthright Citizenship is meant to impact. Why listen to talking heads. Go read for yourself.
I've collected links to all of the filings by the parties in the Birthright citizenship case for next wednesday as well as a link to what I think is the Amicus brief you should at least try to read. You can never go wrong with @akhilreedamar.bsky.social

“If Anthropic is pushing back now” by refusing to let us fly unmanned AI drones “whats going to stop them from installing a kill switch in the future?” -DOJ - Anthropic v DOW
Every time I hear the DOJ lawyer stress the word “War” to let his bosses know he’s not calling it department of “Defense,” I think “Department of War/Them”
Anthropic v Dept of war preliminary injunction hearing underway right now. (Sorry)
Anthropic attorneys state that DOJ is justifying use of supply chain risk designation any time a contractor doesn’t give into contract demands by the DOD. (Live-blogging Anthropic v DOW)
Judge may be backing DOJ lawyer into a corner. Why is supply chain risk designation needed? Lawyer says that the restriction only needs to go so far, but when the judge suggests that DOW use his exact words instead of the “official designation” he backs off. It seems that designation means more
Judge: “If a contractor uses Claude created code, would the contractor face termination?” DOJ: “My understanding is no.” (Live-blogging Anthropic v DOJ) (slightly paraphrased)
DOJ on DOW’s behalf seems more than willing to step back from most of Pete Hegseth’s assertions about Anthropic, recognizing that the secretary had no power to order other agencies or contractors to stop using Anthropic (outside of actual defense work by DOD contractors). The judge seems suspicious
DOJ: “I’m not aware of any authorities that would allow DOW to categorically bar work for non DOW” Judge Lin: “So why did secretary hegseth say this?” DOJ: “I don’t know”
Judge Lin: “Is it accurate that DOW does not intend to terminate any contractor based on their work with Anthropic separate from their work with DOW?” DOJ atty: “DOW’s present concern is their work with DOW Personnel.” (He immediately walks back this statement.) - live blogged.
“You’re saying ‘we said it but we didn’t really mean it?’… how is anthropic supposed to know that?” Judge Lin. Anthropic v DOW. Live blog.
Feds say the last quote is not a final government action, and therefore not ripe for court action.
Anthropic’s “sanctimonious rhetoric” in restricting the federal governments ability to use ClaudeAI to pilot lethal drones is the reason for the federal government’s edict that no contractor doing business with the military could do any business with the government going forward. - Live hearing.
Today at 10 AM ET, I’ll be live on YT, TT, and Substack with the SCOTUS oral args - can a bankruptcy debtor be banned from suing after a car accident? Can the Feds refuse to hear asylum cases from people who aren’t technically “IN” the U.S. yet, when they’re requesting at the border? Join me!
10 AM Eastern Today, I'll be live on YT, Substack, and TT, all at Brynodc with SCOTUS Arguments on whether mail in ballots should be counted (when allowed by state law) if posted before but received after election day. RNC has hired heavyweight Paul Clement and DOJ sending John Sauer Against States.
I’ll be live on Substack, TikTok, and YouTube with the Supreme Court tomorrow morning as the Republican National Committee attempts to reduce the number of votes counted in Watson v RNC. @brynodc on all 3.
