Legal action is expensive, and we can’t do it without public support.

Please help us fund this case and defend EU citizens’ right to travel and return home.

We’ve tried persuasion for years: letters, evidence to Parliament, committees, meetings.
Nothing has changed.

So now, we’re going to court.

The government’s position isn’t just cruel - we believe it’s unlawful.

The Withdrawal Agreement is clear: people with a pending application should be able to return to the UK.

One person told us:
“I have nightmares all the time. I dream I’m watching the plane leave — and there’s nothing I can do.”

This is the human cost of delay.

2 months ago 1 1 1 0

Nearly 80,000 people are affected.

Many are separated from family, unable to attend funerals, care for elderly relatives, or deal with emergencies abroad.

2/ If you’ve applied to the EUSS and are still waiting, the Home Office says you shouldn’t leave the UK - because you might not be allowed back in.

This can last years.

We need your help to take the Home Office to court.

EU citizens waiting for EU Settlement Scheme decisions are being effectively trapped in the UK. 🧵⬇️

Children under 18, and family members/joining family members can't benefit from automation either. It's only EEA & Swiss citizens, who arrived before Dec 2020, and are over 18.

3 months ago 1 0 1 0

It’s only based on existing data from HMRC and DWP, and cases are only considered for it when pre-settled status is close to its initial expiry date.

3 months ago 1 0 1 0

Automation has been implemented, and by Sept 2025, 53,750 people had been granted settled status through it. Not everyone who qualifies for settled status will be able to be granted it through the automatic process though.

The system that we all rely on to prove our immigration status in the UK...is down right now.

There is no alternative, no physical back-up, so no way of showing your employer, your landlord, or anyone else that you have the right to live here.

8 months ago 10 6 0 4

This heartbreaking situation highlights the urgent need for the Home Office to recognise the disproportionate impact the eVisa system has on older and vulnerable people. Technology is failing many people like Liudmyla when they need it most.

"When my mother got to the airport, the staff just kept not listening when she showed them the email from the Home Office. They were just saying ‘it’s your problem’."

This is what happens when the border is being pushed out and people have no physical proof of their rights.

Ukrainian grandmother stranded after being refused flight to UK over eVisa issues Her daughter Maria said the new electronic visa system was difficult for elderly people to navigate

Liudmyla (78) was stranded for days at Krakow airport, not allowed to come back home to the UK. She'd spent 25 hours on a bus from Ukraine, and despite having the right to live here, she was denied boarding. www.independent.co.uk/news/uk/home...

How can I check I’ve been in the UK for 30 out of the last 60 months, to be eligible for settled status? Do you have pre-settled status?
You can use our absence calculator to see if you can qualify for settled status under the new rule.

If you don’t yet, the calculator will tell you the future date when you may be eligible.

Download the absence calculator: www.the3million.org.uk/absence-calculator

How the calculator works

You enter the date you first arrived in the UK and all the dates you were absent from the UK in the last 5 years (and any planned future absences).

It shows you if the total absence is less than 30 months in the last 60 months.

If the total absence is more than 30 months (or if you’ve not been resident for at least 5 years), it will tell you the future date when you may be eligible.
