Got my first ChatGPT "legal brief" from a client today lawsplaining to me how their meth cases should be dismissed and quoting case law they clearly haven't read because the actual holding in the cases undercuts their arguments.

I refuse to do it. When they try to steer me to the self-checkout, I tell them no and I tell them why. "Because if I make a mistake, this store will have me charged with a crime. I've seen it."
We have Class A (first degree murder) to Class I (simple possession of small amounts of cocaine or meth). Then four classes of misdemeanors.
As misdemeanors lately. For a while, they were charging class G felony Obtaining Property by False Pretense, which doesn't require any monetary threshold.
If they charge as Obtaining Property by False Pretense, it's a class G felony in NC, regardless of the amount taken. I've seen panhandlers charged with felonies for cadging $5 in gas money.

It's all about balancing the state budget on the backs of the poor by terrorizing them into paying fines and fees.
My colleagues and I are having some success by digging in our heels and getting dismissals on the cases that are obviously just fuckups. DA's are getting more skeptical.
More often, if they pled, they'd get probation: court cost, supervision fees, community service fees, etc. It's more about adding to the General Fund than locking people up (which costs more money than it takes in),
Target, Walmart, and Harris Teeter are frequent alleged victims.
It gets better. As so often happens when the State doesn't have squat, they'd offer a misdemeanor larceny and probation, which a Defendant terrified of facing a felony trial would accept.
Lately, I'm seeing more misdemanor larceny charges from the start, and more outright dismissals.
