I was thinking more of a lottery system. If you make them pick in turn, that might defeat the purpose (Rs will pick Rs, Ds will pick Ds). But random assignments takes away the urge to hire in function of ideology in the first place…

I don’t agree on “no clerks”. Every supreme court in the world have them, and it works perfectly fine. The problem is in the hiring of ideological minions. So have every justice hire 4 clerks, and then assign them randomly. They’d have the incentive of hiring the best available, without the ideology
