An article authored by yours truly and @gregcastanias.bsky.social (in 2000!) was cited in an amicus brief in Hunter v US, argued in SCOTUS today.
It’s Babyface. Or Marc Summers from Nickelodeon. Or maybe
(egads) Jared from Subway. I’d prefer it to be Priyanka Chopra, but she attended for only one year, and didn’t graduate from there.
NEW: “CBS Evening News” producer Alicia Hastey sends a bombshell farewell note:
Stories are “evaluated not just on their journalistic merit but on whether they conform to a shifting set of ideological expectations.”
Taking my dog out for his constitutional in the post-snow-and-ice-storm DMV, watching him on the ice sliding away from his target on three paws and one lifted leg, and trying not to humiliate him more with my laughter.
I think liberals ought to reengage this discourse. We dismissed manhood and masculinity as phony things unworthy of serious, positive discussion, and left it on the table for the chodes and assholes among us. Alex Pretti was what a good man should be. We should say so.
The 2024 election got framed for these less-political folks as “Democratic failure and incompetence” versus “Strongman solutions.” And the latter won out. At some point, we need to seize a simple message: We are good people who are good at governing. If you have a moral center, you should support us. And if you don’t much care about such altruistic things, but you do care about things like the price of eggs, we’ve got your back, too. That leaves the MAGA party — f/k/a the Republican Party — to campaign on “I hate the people you hate; fear the people you fear.” We don’t favor sane and compassionate immigration policy because of identity politics; we favor it because it’s going to be good for the country — shores up the work force, adds to the public fisc, etc.
I have an amazing community at the Editorial Board. Just look at this reaction to a piece of mine called "Can liberals help maga find the off-ramp?" So informed. So wise.

Camp East Montana in El Paso, Texas. Three migrants held there have died since December 2025.
A third immigrant held at Camp East Montana has died, reportedly by suicide. Victor Manuel Díaz was detained in Minnesota. He is the sixth migrant to die since Jan. 1 in ICE detention.

This continues a dangerous campaign.
The day before the ICE killing, the Commander-in-Chief reposted a “Truth” that said “Literal [sic; ‘Liberal’] YT Women [are] The Most Damaging creatures on Earth!”
14 hrs later, ICE executes a liberal white woman while the officer calls her a “fucking bitch.”
This article refers to “Brown” in the second paragraph as though the reader already knows who he is. But the reader has to infer that this is the former CEO’s name, which is not given before you call him “Brown.” (It’s John Y. Brown, former Governor of Kentucky, once husband to Phyllis George.)
I am getting ready to start Ian MacEwan’s new book, “What We Can Know.”
Read this to Mrs. C. Her response: “I feel seen.”
This also occurred for 2L law-firm interviews at Georgetown and Harvard. In fact, I interviewed Savannah Guthrie, then an ex-Arizona journalist and GULC 2L,
In a DC hotel room.
It is likely that the episode will be remembered more for the couthless lout than for anything about you. Until they died, my parents laughed about this roughneck customer from my Dad’s restaurant who, observing the regrettable behavior of another customer, said, “Dat guy ain’t got no couth.”
Welp. BlueSky is over. It isn’t ever going to be done better than this.
We had the distinct honor of representing the Top Brands companies and John Ngan in this case. Thanks to @design-law.bsky.social (Sarah Fackrell) for highlighting it.
PM me and let me know what you need and I’ll see if I can be of help.
I’m at ALI’s Annual Meeting. During yesterday’s CLE on Generative AI, I decided to experiment by asking AI a question about an issue I’ll be addressing soon in an upcoming argument. It gave me an authoritative and exactly-on-point quote from a Restatement. One problem: It wasn’t in the Restatement.
Strikes me as a problem for the administration if they decide to withhold evidence of their compliance, which they’ll have to demonstrate.
My father, child of two immigrants who got here from Greece just before Congress passed its first aggressively nativist immigration law (the Johnson-Reed Act of 1924), piloted 35 combat missions in a B-17 over Nazi Germany. He didn’t bomb Nazis so that a cosplaying Naziferatu could pull this crap.
