OPT 1-Get the NCSBE to change its mind and order a full hand recount
OPT 2-Have election protest in Guilford County unearth greater issues

And even after all that, Berger's four election protests, which have been partially met with cold water already in GOP-controlled election boards, cumulatively add up to 13 votes (not the 23 needed to take out Page's lead).
Acute #ncpol readers may have noticed a shift in how I'm discussing the Page-Berger race. I've labeled Page as the "apparent winner." Why? Machine recount changed nothing, Berger still trails Page by 23, and NCSBE doesn't look receptive to Berger's push for a full hand recount.

What will the NCSBE do? It has some discretionary authority, but granting this request would leapfrog the process the board has already outlined. Hand recounts are supposed to happen after machine recounts, and the sample of ballots selected is random (not done as selectively as Berger wants) #ncpol
What this race now boils down to: Will the NCSBE grant approval for a hand recount of 217 #SD26 voters who likely chose not to vote in the GOP primary? We'll find out at 10am tomorrow. And if the NCSBE denies Berger's request, will a court step in?
Topline: Berger's in deep math trouble. If you grant all his election protests and assume everyone voted for Page, Berger nets 13 votes. 2024 SupCo recount netted Riggs six votes in Rockingham+Guilford. So recount + protests very unlikely to net Berger 23.

The NCSBE will meet at 10 a.m. tomorrow to discuss the Berger recount request and whether to exercise discretion to do a partial hand recount to review the 220 ballots Berger is requesting. Adoption of permanent rules for noncitizen list maintenance is also on the agenda. #ncpol
Of NC's 100 counties, there was only one county in 2024 SupCo race where a machine recount produced a net swing of more than 23 votes: Randolph County. This stemmed from a miscounting of absentee ballots on Election Night. #ncpol
How might a machine recount pan out? For perspective, in the 2024 NC SupCo general election race (much higher turnout), Guilford County saw a 5-vote swing in favor of Riggs over Griffin. Rockingham Co. saw a 1-vote swing in favor of Riggs. Berger presently trails by 23. #ncpol
But broadly speaking, an overvote is generally when a voter circles both candidates' names and an undervote is when someone doesn't vote in the race at all. #ncpol
In his recount request, Berger raised concerns over 220 ballots, including 3 "overvotes" and 217 "undervotes." The deadline for an election protest is 5pm today.
When asked for clarity on what wrongdoing Berger was alleging, campaign deferred back to letter and the NCSBE. #ncpol
