In the example above Roy is not the accused on trial but I understand what you’re saying. Def. an argument that it’s being offered to show affect on listener, not truth of the matter asserted. But then you still have confrontation objections to contend with. Might some judges still let it in? Sure.
There’s one too many layers of hearsay in that hypo for it to be admissible (before you even get to the confrontation objection). But because a defendant’s statement is admissible under the “admission of defendant(party opponent)” exception to hearsay, Roy can testify to what defendant told him.
Totally. I’m not trying to correct you in any way, btw, just adding to your comment and trying to further distinguish the ideas of evidence for “public opinion and political purposes” use versus evidence that can be used at trial. The thread seemed to be conflating these.
There’s confusion (not in bad faith) in this thread between whether something is “evidence” in the broad sense of the word, or “evidence that is admissible at trial.” For example, a statement by a defendant to police under conditions that don’t violate Miranda is admissible at trial.
