It really does. A lot of AOSTH releases do, for how much of them use the SATAM art. Mario Super Show has a similar issue, since some releases had screen caps from the Mario Bros 3 cartoon.
Similarly, the French DVDs for the Donkey Kong Country show used assets from DKC1, Mario Kart Double Dash, Smash Brawl and so on. Right next to each other, like in the Tubi cover for AOSTH.
The image on the right is the one used on Tubi, the one on the left is the one I drew. Certainly wouldn't mind if they ever started using mine, tho...
It is very strange. AOSTH in general seems to run into issues with the promotional art, the most common being the blue-armed Sonic and the appearance of the SATAM version of Dr. Robotnik. Which makes me appreciate all the more how the Discotek Blu-ray decided to make new art of the show instead.

To each their own. I found much of the soundtrack to be frustratingly meandering and often having little to do with Donkey Kong-- appropriate for the game. There have been good DK OSTs made by someone other than David Wise, yet I can't help but think it funny that an indie DK got him instead of Nin.
