The Town of Newburgh will be the first New York municipality to adopt Proportional Ranked Choice Voting in response to litigation under NYVRA, showcasing significant progress towards a more equitable democracy.
The implementation of Proportional Ranked Choice Voting allows voters to express candidate preferences in voting, and under this method, Black and Hispanic voters will have a realistic opportunity to elect candidates of their choice.
This landmark legislation and the Town’s switch in electoral system are a step toward ending vote dilution for Black and Hispanic voters, allowing them to have a fair seat at the table.
ELC and co-council represented Black and Hispanic voters in Clarke v. Town of Newburgh, one of the first cases litigated under the New York Voting Rights Act (NYVRA).
ELC, along with Abrams Fensterman, is proud to announce that the Town of Newburgh has agreed to switch its electoral system for Town Council to a Proportional Ranked Choice Voting system as part of an agreement to settle litigation.
She also testified in support of HB350 which would, if enacted, prohibit municipalities and counties from implementing election methods that would dilute or abridge the rights of members of protected classes.
ELC member Maria Nolan testified before the Maryland State Senate Government Labor and Election Committee in support of HB219, which aims to prohibit voter suppression and intimidation that inhibits democratic opportunities to freely elect candidates.
ELC January-term student Andy Hatem prepared plaintiffs and a key witness for trial through mock cross examinations. Both students were proudly supervised by Clinical Director Ruth Greenwood.
In January, ELC advanced student Louie Goldsmith represented plaintiffs before the Norfolk County Superior Court. Louie provided an opening statement and conducted direct and cross examination for key witnesses.
