So, when will this happen? A vote is not expect before the Easter break, but could still take place in April - meaning that Wiewiórowski, who has been acting EDPS for over a year, could face an end to his mandate this summer.
Should Gencarelli be confirmed, he could likely steer European data protection in a new direction. Could he, for instance, drop litigation meant to curb indiscriminate data collection by Europol launched by Wiewiórowski? This decision could have big consequences.
Last year, EU countries picked Wiewiórowski (14 votes) over Gencarelli (13). But MEPs chose Gencarelli (40 points) over Wiewiórowski (33) using weighted votes.
Under the new procedure, if member states and MEPs stick to their guns, Gencarelli has a small edge of 28 to 26 votes over Wiewiórowski.
The two only candidates for the job are Wojciech Wiewiórowski, the current EDPS who has proven a thorn in the sides of Council and Commission, and Bruno Gencarelli, who lead the Commission's unit for international data flows.
Who is most likely to win under the new rules?
The new procedure gives Council and Parliament each 27 votes in a joint ballot. The EP votes will be cast by LIBE group coordinators according to group weight. The majority for passing will slide from first voting round (3/4) to simple majority in the third round - the smallest edge will suffice.

Politicians are unsure which way to turn. Last December, the European Commission scrapped a 2035 ban on selling new petrol or diesel cars. Instead, under pressure from Germany and Italy, it let manufacturers keep making cars with up to 10% of their current exhaust emissions past that date – in effect, a way to keep selling combustion engines.
Another day, another media outlet getting this wrong. No, the EU has not scrapped the combustion engine ban, at least not yet. It's an ongoing, highly contingent lawmaking process, not a fait accompli. And it's not a detail, either.
