More serious concern is trans people who married under the old policy without knowing that they were technically not being married legally correctly getting their marriages annulled if their partner outs them during divorce

Sex on birth certificate is Legal sex. That's how it's defined. Sex on documents non BC docs may be different to legal sex. GRC changes it.
Of course we all now have a mysterious undefined "biological" sex in addition to our previous social and legal ones, which has no corresponding documentation.

Likely policies elsewhere will be exactly the same unfortunately. Getting a civil partnership which has no compulsory gendered wording of any kind may be more viable than cancelling expensive wedding stuff. Depending on how far off date is, plans etc

It's incredibly distressing situation to be in, and people often have absolutely no idea, like you, until they are registering or literally on their wedding day. Often long after wedding things have been booked and can't be moved to wait for a GRC. It's absolutely awful and I'm so sorry.

Registrar did not cite FWS just policy change from right after FWS. There's no case here unfortunately.

I think it might be possible to do different wording if getting a civil partnership instead of a marriage, but the law here is absolutely awful

Yeah I think it's likely they checked if it affected them and noticed their policies didn't reflect the GRA and that people's passports often don't match their legal sex.

Marriage is unfortunately dependent on legal sex. This is one of the few things you need a GRC to change, it's really awful and pointless. Previously they just often didn't check and assumed people were cis or had a GRC if their passport was updated.

This was technically the case before FWS unfortunately. Marriage certificates/wording being one of the big things a GRC changes. This should have been completely unaffected by the SC because it's a GRA change, not EA.
In practice it was often unenforced though.

Many of these women have a sexuality complaint, and a prejudicial view of trans people which drives their fear and discomfort. This doesn't make their fear and discomfort fake.
